Welcome to Paddlly. These Terms of Use explain the rules and conditions that apply when you access or use the Paddlly website, mobile application, and related services.

Paddlly is owned and operated by Mercury Services LLC. For purposes of these Terms of Use, “Paddlly,” “we,” “our,” or “us” refers to Mercury Services LLC and the Paddlly website, mobile application, and related services.

By accessing or using Paddlly, you agree to these Terms of Use. If you do not agree to these Terms of Use, you should not use the Paddlly website, mobile app, or related services.

1. About Paddlly

Paddlly is a social mapping and float trip planning platform designed to help users discover, organize, and share canoe, kayak, rafting, camping, and river experiences.

Paddlly may include features such as trip planning, saved pins, map tools, Float Mode, route planning, location-based search, campground information, outfitter information, access point information, group trips, friend requests, messaging, comments, reviews, photos, vendor listings, sponsored placements, and other outdoor recreation tools.

Paddlly is provided for general planning, organization, mapping, social, and informational purposes only. Paddlly is not an emergency service, professional guide service, weather service, river authority, outfitter, campground operator, rescue service, or substitute for personal judgment and proper outdoor preparation.

2. Eligibility

You must be at least 13 years old to use Paddlly. If you are under 18, you may use Paddlly only with permission from a parent or legal guardian.

By using Paddlly, you represent that you meet these eligibility requirements and that you have the legal authority to agree to these Terms of Use.

3. Account Registration

Some Paddlly features may require you to create an account. When creating an account, you agree to provide accurate, current, and complete information.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree not to share your password, allow unauthorized access to your account, or use another person’s account without permission.

4. User Responsibilities

When using Paddlly, you agree to use the platform responsibly, lawfully, and respectfully.

You are responsible for:

  • The accuracy of information you submit
  • Your own outdoor safety and preparation
  • Checking river conditions, water levels, weather, and local regulations
  • Using appropriate safety equipment
  • Respecting private property, public land rules, and campground rules
  • Respecting other users
  • Keeping your account credentials secure
  • Ensuring that content you upload or share does not violate another person’s rights
  • Using Paddlly in compliance with applicable laws and regulations

5. Outdoor Safety Disclaimer

Outdoor activities, including canoeing, kayaking, rafting, floating, camping, swimming, hiking, boating, driving, and travel near water, involve risk. These risks may include injury, illness, drowning, property damage, weather-related danger, river hazards, wildlife encounters, poor cell service, changing water levels, navigation errors, and other unpredictable conditions.

Paddlly does not guarantee the safety of any river, route, campground, outfitter, access point, saved pin, map location, trip plan, or user-submitted information.

Before participating in any outdoor activity, you are responsible for checking current conditions, weather forecasts, water levels, river closures, local laws, public safety notices, outfitter guidance, campground availability, emergency access, and your own skill level.

Paddlly should not be used as your only source of safety, navigation, emergency, or trip-planning information.

6. Map, GPS, and Location Accuracy

Paddlly may provide maps, GPS features, saved pins, estimated routes, estimated distances, Float Mode tools, and location-based recommendations. These features are provided for convenience and general planning only.

Paddlly does not guarantee:

  • GPS accuracy
  • Map accuracy
  • Route accuracy
  • Float time accuracy
  • Cell service availability
  • Water level accuracy
  • Weather accuracy
  • Emergency access
  • Campground availability
  • Outfitter availability
  • Access point availability
  • Safety of any suggested route or location
  • Accuracy of user-submitted pins or content

You should independently verify all routes, conditions, and locations before relying on them. GPS, maps, and mobile devices can fail, lose signal, display incorrect information, or become unavailable.

7. Emergency Disclaimer

Paddlly is not an emergency response service. Paddlly does not monitor your safety, dispatch help, contact emergency services, or guarantee that emergency assistance will be available.

If you are in danger or experiencing an emergency, call 911 or the appropriate local emergency number immediately. Do not rely on Paddlly to request, provide, or coordinate emergency assistance.

8. User Content

Paddlly may allow users to create, upload, post, submit, save, send, or share content. User content may include photos, videos, messages, comments, reviews, trip plans, saved pins, location descriptions, event details, group information, reports, and other materials.

You retain ownership of content you create, upload, or submit. However, by submitting content to Paddlly, you grant Paddlly a non-exclusive, worldwide, royalty-free license to use, host, store, reproduce, display, modify, adapt, publish, distribute, and otherwise process that content as needed to operate, provide, promote, improve, and protect the Paddlly services.

You represent and warrant that you have the rights necessary to submit your content and that your content does not violate these Terms of Use, the rights of others, or applicable law.

9. Prohibited Content

You agree not to upload, post, send, submit, or share content that:

  • Is illegal, harmful, threatening, abusive, harassing, or defamatory
  • Invades another person’s privacy
  • Shares another person’s personal information without permission
  • Contains false, misleading, or dangerous safety information
  • Encourages illegal activity
  • Promotes trespassing or violation of private property rights
  • Contains hate speech or discriminatory content
  • Contains sexually explicit or exploitative content
  • Contains spam, scams, phishing, or fraudulent material
  • Impersonates another person, business, outfitter, or organization
  • Violates copyright, trademark, privacy, publicity, or other rights
  • Contains malware, harmful code, or attempts to disrupt the Services
  • Interferes with the safety, enjoyment, or lawful use of Paddlly by others

Paddlly may remove, hide, restrict, or moderate content at its discretion.

10. User Conduct

You agree not to:

  • Use Paddlly for illegal, harmful, abusive, or fraudulent purposes
  • Harass, threaten, intimidate, or abuse other users
  • Use Paddlly to stalk, track, or monitor another person without permission
  • Submit false reports, false locations, or misleading safety information
  • Interfere with or disrupt Paddlly’s systems, servers, or networks
  • Attempt to gain unauthorized access to Paddlly or another user’s account
  • Use bots, scrapers, crawlers, or automated systems without permission
  • Copy, sell, resell, or exploit Paddlly without authorization
  • Reverse engineer, decompile, or attempt to extract source code from the app except where allowed by law
  • Use Paddlly in a way that violates applicable laws or regulations

11. Community Features

Paddlly may include community features such as friend requests, group trips, messaging, shared pins, comments, reviews, public posts, and user-submitted location information.

You are responsible for your interactions with other users. Paddlly is not responsible for the conduct, statements, actions, or content of users. Use caution when meeting, communicating with, traveling with, or sharing trip details with other people.

Paddlly may review, remove, restrict, or disable user content or accounts if we believe they violate these Terms of Use, create safety concerns, or may harm Paddlly, users, or others.

12. Public and Shared Information

Some information you submit through Paddlly may be visible to other users or the public, depending on the feature and your settings.

Public or shared information may include your username, profile photo, shared pins, public comments, reviews, trip details shared with trip members, group messages, uploaded media, or location submissions.

Do not share information through Paddlly that you want to remain private. You should use caution when sharing personal information, exact locations, travel plans, photos, or trip details.

13. Intellectual Property

Paddlly, including its name, logo, branding, website, app design, graphics, text, features, software, code, content, and related materials, is owned by Mercury Services LLC or its licensors and is protected by intellectual property laws.

You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, sell, license, or exploit any part of Paddlly except as allowed by these Terms of Use or with written permission from Mercury Services LLC.

14. Limited License to Use Paddlly

Subject to your compliance with these Terms of Use, Paddlly grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Paddlly website, mobile app, and related services for personal, non-commercial use.

This license does not allow you to copy, modify, sell, resell, distribute, reverse engineer, or commercially exploit Paddlly without permission.

15. App Store Terms

If you download Paddlly from the Apple App Store, Google Play Store, or another app marketplace, your use of the app may also be subject to the terms, conditions, and policies of that app store.

The app store provider is not responsible for operating Paddlly, providing support for Paddlly, or handling claims related to Paddlly, except as required by its own terms or applicable law.

16. Subscriptions, Paid Features, and Purchases

Paddlly may offer free features, paid features, premium storage, subscriptions, vendor listings, sponsored placements, or other purchases.

If paid features are offered, pricing, billing terms, renewal terms, cancellation options, and refund rules may be displayed at the time of purchase or through the applicable app store, payment provider, or Paddlly checkout process.

If you purchase through Apple, Google, or another third-party payment provider, your purchase may be subject to that provider’s payment, cancellation, and refund policies.

Paddlly may change, add, remove, limit, or modify paid features, storage limits, subscription benefits, pricing, or availability at any time, subject to applicable law and any terms presented at purchase.

17. Vendor Listings and Sponsored Placements

Paddlly may display local vendor listings, outfitter listings, campground information, advertisements, sponsored placements, promoted content, or other commercial content.

Paddlly does not guarantee the accuracy, availability, quality, safety, pricing, services, products, or performance of any vendor, outfitter, campground, sponsor, advertiser, or third-party business listed on Paddlly.

Any transaction, communication, booking, reservation, purchase, or agreement between you and a third-party business is solely between you and that third party. Paddlly is not responsible for third-party goods, services, claims, cancellations, refunds, injuries, losses, or disputes.

18. Third-Party Services and Links

Paddlly may link to or integrate with third-party services, including map providers, payment providers, app stores, social media platforms, authentication providers, analytics tools, hosting providers, advertisers, vendors, outfitters, campgrounds, or other websites and services.

Third-party services are governed by their own terms and privacy policies. Paddlly is not responsible for third-party content, security, availability, accessibility, policies, services, or practices.

19. Privacy

Your use of Paddlly is also governed by our Privacy Policy. The Privacy Policy explains how we collect, use, store, share, and protect information when you use Paddlly.

20. Availability and Changes to the Services

Paddlly may change, update, suspend, discontinue, limit, or remove any part of the Services at any time. We do not guarantee that Paddlly will always be available, uninterrupted, secure, error-free, or compatible with every device, browser, operating system, or location.

We may release updates, bug fixes, feature changes, or other modifications. Some features may require app updates, internet access, location permissions, or compatible devices.

21. Account Suspension or Termination

Paddlly may suspend, restrict, or terminate your access to the Services at any time if we believe you have violated these Terms of Use, created safety concerns, infringed the rights of others, abused the platform, or used Paddlly in a way that may harm Paddlly, users, third parties, or the public.

You may stop using Paddlly at any time. You may request account deletion by contacting mercuryservicesus@gmail.com.

22. Disclaimer of Warranties

Paddlly is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Paddlly and Mercury Services LLC disclaim all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, reliability, safety, and uninterrupted operation.

We do not warrant that Paddlly will be accurate, complete, current, secure, error-free, uninterrupted, or free from harmful components.

23. Limitation of Liability

To the fullest extent permitted by law, Paddlly, Mercury Services LLC, and their owners, officers, employees, contractors, service providers, affiliates, and partners will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, data, goodwill, use, or other intangible losses.

Paddlly is not responsible for injuries, accidents, property damage, lost items, route errors, weather conditions, river hazards, user conduct, third-party services, or decisions made based on information displayed through Paddlly.

Your use of Paddlly and participation in outdoor activities is at your own risk.

24. Indemnification

You agree to defend, indemnify, and hold harmless Paddlly, Mercury Services LLC, and their owners, officers, employees, contractors, service providers, affiliates, and partners from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising from or related to your use of Paddlly, your content, your violation of these Terms of Use, your violation of law, your violation of another person’s rights, or your participation in outdoor activities.

25. No Professional Advice

Information provided through Paddlly is for general informational and planning purposes only. Paddlly does not provide legal, safety, weather, emergency, medical, professional outfitting, navigation, or outdoor guide advice.

You should consult qualified professionals, local authorities, outfitters, park services, emergency services, weather services, and official sources when making decisions related to outdoor activities, travel, safety, routes, water conditions, or legal requirements.

26. Copyright and Intellectual Property Complaints

If you believe content on Paddlly infringes your copyright, trademark, or other intellectual property rights, contact us at mercuryservicesus@gmail.com.

Please include enough information for us to identify the content, understand your claim, and contact you about the issue.

27. Governing Law

These Terms of Use are governed by the laws of the State of Missouri, without regard to conflict of law principles, unless applicable law requires otherwise.

Any disputes related to these Terms of Use or your use of Paddlly will be handled in the appropriate courts located in Missouri, unless applicable law requires another venue.

28. Changes to These Terms

We may update these Terms of Use from time to time. Updated versions will be posted on this page with a revised effective date or last updated date.

Your continued use of Paddlly after updated Terms of Use are posted means you accept the revised Terms of Use.

29. Severability

If any part of these Terms of Use is found to be invalid, unlawful, or unenforceable, the remaining sections will remain in effect to the fullest extent permitted by law.

30. Entire Agreement

These Terms of Use, together with our Privacy Policy and any additional terms presented within Paddlly, make up the entire agreement between you and Paddlly regarding your use of the Services.
